| Profile
CV |
A
publically accessible advert, submitted by users. Containing
and advert of Profile CV Details and of Positions Wanted. |

Networks |
A
list of standard networks setup on the site for users o join,

| Custom
Networks |
A
list of Custom Networks. Custom networks are suggested by Network
Sponsors. |

Mail |
An
internal mail box of messages from other site users. |

Mail |
A
sent mailbox of messages sent to other users. |
| Message
Boards |
The Message Boards contain the messages for each of the networks.
Users may access the "Message Board" messages for
each of the networks they have joined. |
2 Terms of use
FD.COM may change
these terms and conditions from time to time. By accessing the Site
you are accepting that you are bound by the current terms and conditions.
You are therefore responsible for checking these each time you visit
the site.
The information
and services available on the site are principally for the purpose
of assisting individuals in finding employment and making career
decisions and to assist employers in recruiting staff. You may use,
print and download information from the site for these purposes
only and for no other personal or commercial purpose. You may not
otherwise copy, display, transmit or distribute any material from
the site.
All copyright, database rights and other intellectual property rights
in the site and the material available on the site belongs to FD.COM
or its third party suppliers. Use of the site does not give you
any proprietary rights in such materials.
3 Data Protection
Our use of CVs and other personal information supplied by users
of this site is governed by our [ Privacy

Site Rules
You
agree that FD.COM may at its discretion:
a. Refuse membership of the site.
b. Withdraw entitlement to the "Jobs Newsletter" without
prior notice.
c. Deny inclusion in the "Financial Directory" part of
the site.
d. Deny inclusion in the"CV" Database.
e . Remove any "CV's", or "Profile CV's" without
prior notice.
f . Withdraw membership of the site without prior notice.
g . Remove any Job Advertisement without prior notice.
h . Deny access to the site from Job Advertisers , without prior
notice.
i . Refuse to allow access to the site for Job Advertisement purposes.
j. Amend the rules at its discretion, without prior notice.
k. Refuse network membership.
l. Withdraw network membership without prior notice.
m. Refuse access to "Inbox Mail" and "Sent Mail"
messages.
n. Delete "Inbox Mail" and "Sent Mail" messages
without prior notice.
o. Deny access to "Message Boards".
p. Remove "Message Board" notices without prior notice.
q. Remove "Network Sponsors" without prior notice.
r. Users login and password details can be deleted at any time without
prior notice.
The rules may change from time to time and you are advised to refer
to them regularly.

Rights
Any intellectual property rights in any material (text,
networks, images, logos, trademarks) contained in the site are either
owned by Finance Director .com Limted, or have been licensed to
Finance Director . com Limited by the rights owner so that Finance
Director. com Limited can use the material as part of its site.
All intellectual property rights associated with the Standard and
Custom networks are owned by FD.COM. Network Sponsors have no rights
in any of the networks.
Database rights (pursuant to the Copyright and Rights in
Databases Regulations 1997) and all other applicable copyright and
intellectual property rights in the candidate database belong to
FD.COM. You acknowledge that you do not acquire any rights in the
database or its content and that your retention and use of the database
and its content is governed by these terms and conditions.
6 Responses to Advertisements
You
agree to deal fairly and professionally with individuals who may
respond to an advertisement you have posted and not do anything
which may bring FD.COM into disrepute. You will indemnify FD.COM
from and against any claim brought by an individual against FD.COM
arising from your breach of this obligation or any other of these
terms and conditions.
We do not guarantee any response to your advertisement or that responses
will be from individuals suitable for the job advertised. It is
your responsibility to carry out such checks and procedures as are
necessary to ensure that candidates are suitable for the job advertised
and have the required qualifications and personal characteristics.
7 CV's and Job Advertisements
CV's and job advertisements contained on the site are provided by
candidates and by prospective employers and their agents. We accept
no responsibility or liability for the contents of CV's or advertisements
and expect candidates and prospective employers to carry out such
verification procedures as are customary and prudent in the circumstances.

Use of the Database
The
material accessible from the database will be principally data obtained
from "Job Searches" and information received from "CV
Searches". In respect of data obtained from "CV Searches"
you are entitled to search the CV Database:
You may:
i. Use, search or download from the database for the purpose of
finding suitable candidates for specific job vacancies that you
or (if you are an employment agency or employment business) your
client wish to fill.
ii. Use the information about the individuals contained in the database
for the purpose of contacting them (either directly or through FD.COM
) in relation to a specific job vacancy.
iii. Use the information only in connection with your own recruitment-related
activities.
You may NOT:
i. Supply, sell or
license material from the candidate database, or a copy of it, to
any other person, including another member of your group of companies.
ii. Contact the individuals on the database or make or allow any
use of the information about those individuals, other than for the
purpose of finding suitable candidates for specific job vacancies.
You must, at all times, comply with the Data Protection Act 1998
and all subsequent legislation and regulations.
9 Deletion of Database Material
You agree to delete all material from the candidate database upon
its replacement with up-to-date material or the satisfactory conclusion
of your search for a suitable candidate, whichever occurs first.
10 FD.COM Services
Services and information provided on the site by us and our third
party suppliers are intended to assist in the job seeking or recruitment
process. Neither we nor our third party suppliers can guarantee
their suitability or prospects of success in any particular case.
You should obtain independent verification before relying on information
provided on the site in circumstances which may result in loss or
damage.
11 Site Availability
We use our best
efforts to ensure that FD.COM is available to users of the world
wide web 24 hours a day, 7 days a week. However, at times the site
may be partially or completely unavailable due to technical faults
or reasons beyond our control such as failures by third party service
providers or a risk of virus attack. We will deal with these situations
as quickly as reasonably possible, but you agree that we shall have
no financial liability to you in the event of such unavailability.
12 Limitation of Liability
Finance Director .com does not verify or guarantee any Applicant's
details whether forwarded to the Client via Finance Director .com
Limited or otherwise. Finance Director .com Limited accepts no responsibility
as to the suitability of Applicants who respond to Advertisements
or Services.
The Client shall satisfy itself as the suitability of any Applicant
and shall take up any reference prvided by the Applicat before engaging
any Applicant.
The Client shall be responsible for obtaining work, or any other
permits, for the arrangemtns of medical examinations, and/or investigations
into medical history of any Applicant, and shall satisfy itself
of any medical or other requirements made by law.
Our liability, and the liability of our third party suppliers, for
any loss or damage suffered by you as the result of your use of
this site is limited to your actual direct damages and, except in
the case of fraud, excludes any loss of future earnings, profit
or prospects or any consequential or speculative loss. As required
by law, this exclusion does not extend to death or personal injury
caused by our negligence. Please read the separate section on disclaimers.
Advertisements for jobs are placed by the advertisers and are not
the responsibility of Finance Director . com Limited. You agree
that the obtaining or viewing of any advertisements for jobs or
any other material (Profile CV's, Network Messages etc) through
the use of the service is carried out at your own risk and that
Finance Director .com Limited has no liability in respect of such
things.
13 Indemnity
The client agrees to indemnify Finance Director . com Limited and
to keep Finance Director . com Limited indemnified in respect of,
but not limited to, all damages, costs or liabilities that Finance
Director . com Limited may incur arising from an Advertisement or
use of any Service, and in particular resulting from the following:
a) the publication of a defamatory statement;
b)breach of copyright;
c) any claims made by any person in respect of race, religion, age,
sex or disability discrimination.
14 Governing Law
These terms and conditions shall be interpreted in accordance with
English law and all disputes shall be decided by the English courts.

Passwords
Passwords are for the sole use of the person to whom they are issued.
We may deny access to a password if we reasonably believe that it
is being used by an unauthorised person or that the user is breaching
these terms and conditions.
16 Browser and Operating System Policy
FD.COM endeavors to support as many users as possible, but it has
become necessary to cease supporting or actively block some browser
versions.
FD.COM also requires job seekers to enable session cookies (enabling
permanent cookies is recommended), and JavaScript, in their browser.
The site is optimised for use on
Internet Explorer 6.0.
